General Terms & Conditions

1. Scope
The General Terms and Conditions (hereinafter referred to as “GTCs”) apply to all orders placed via the ARKO International Sarl online shop (hereinafter referred to as “hotbin.ch”) and all contracts concluded (hereinafter referred to as “orders”).
hotbin.ch reserves the right to change the GTCs. The valid version of the GTCs at the time of placing the order shall apply. It may not be amended unilaterally for the relevant order.

2. Offers
Offers are made to customers who are either natural persons or legal entities domiciled in Switzerland. Deliveries may be made only to addresses in Switzerland.
Offers are valid for only as long as they appear on the online shop and/or while stocks last. hotbin.ch may change its prices and product range at any time. The images used in advertising media, brochures, on the online shop, etc. as well as all information about the products themselves are for illustrative purposes only and are non-binding. Only the specific information displayed on the product packaging shall apply.

3. Pricing
Prices are displayed in Swiss francs and include value-added tax (VAT) and Shipment.
The prices stated on the online shop at the time of placing an order shall apply.

4. Ordering
The presentation of products on the online shop shall not constitute a legally binding proposal but rather a non-binding online catalog or non-binding invitation to customers to order a given product on the online shop. hotbin.ch reserves the right to limit the delivery quantities of specific products.
Placing an order shall constitute an offer to enter into a contract with hotbin.ch.
Following placement of the order, the customer is automatically issued with a confirmation by hotbin.ch, documenting receipt of the order. Customers may cancel or add to their order only until order processing commences at our logistics center.
hotbin.ch may reject an order, either in its entirety or in part, without stating the grounds. In such cases, hotbin.ch will inform its customers accordingly and refund any payments already made. No other claims shall be accepted. In particular, undeliverable products will not be delivered at a later date. Temporarily unavailable products cannot be pre-ordered.

5. Conclusion of a contract
A contract shall be deemed to be concluded when the order is processed at hotbin.ch logistics center. Customers will receive an order confirmation by e-mail as soon as the relevant order is ready for dispatch.

6. Delivery
DHL has been chosen to deliver products ordered in Switzerland to your home. Delivery is limited to Switzerland and no cross-border delivery is permitted.
In general, confirmed orders are delivered to the address specified in the order confirmation. If you are absent at the time of delivery, you will receive a notice to contact DHL and arrange delivery time. If the product is returned to us, you will be responsible for shipping cost for subsequent delivery.

7. Damaged Goods Returns Policy
The most likely need to contact us will be damage you notice to the HOTBIN caused by transit. Wherever possible if the packaging appears damaged, sign for the item as damaged – it makes claims and replacements so much easier. If you notice damage or a fault please contact us immediately by email at support@hotbin.ch giving the following information:

  • A description of the problem (a photograph often helps)
  • How you believe it was damaged – eg in transit or accidentally during use

If any refunds are due to you, you will receive them through the payment method used by you when purchasing the Goods as soon as possible and in any event within 14 days from when we agree that you are entitled to refund.

8. Change of Mind Policy
If you are not happy with your purchase for any reason, we will accept a return and refund your purchase price. You must inform us within 14 days of receiving the product. The item must be returned in an unused and undamaged condition in its original packaging.
We can arrange collection, but we will deduct a fee of 30chf from your refund if we arrange collection. You are of course welcome to return the HOTBIN at your own cost and receive a full refund.

9. Warranty
Your HOTBIN comes with a 3-year manufacturer’s guarantee on parts with the exception of the thermometers, cam straps, raking stick and empty kick start bottle which have a 12-month warranty.

10. Modes of payment
Payments must be made in Swiss francs.
You may pay by credit card (Visa, MasterCard or PostCard) or PayPal or Bank Transfer. Your account will be debited as soon as the order is confirmed. Upon confirmation of the order, you may not be reimbursed unless you meet the conditions of the Clauses 7 or 8.
We reserve the right not to offer certain payment methods and to refer to other available payment methods. In this case, we are not required to specify the reasons for our decision.

11. Applicable law and jurisdiction
All legal relationships between hotbin.ch and the customer are subject to the substantive law of Switzerland to the exclusion of conflict-of-law provisions and the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention).
The place of jurisdiction for natural persons is Geneva, Switzerland or the customer’s domicile. The exclusive place of jurisdiction for legal entities shall be Geneva, Switzerland.
